Living Q & A: Can I take up part-time work in my time off from my main job?

Q:

My status of residence on my residence card is 'Skilled Labor' (ginō / 技能), and I'm currently working as a cook at a restaurant that serves food from my home country. I'm thinking of taking up a part-time job during my time off from my cooking job. Is there some procedure that needs to be done at an immigration office if I start a part-time job?

A:

If you are engaged in duties to which the status of residence (zairyū shikaku / 在留資格) of Skilled Labor applies, and are considering taking up additional work part time, we recommend that you always consult an office of the Immigration Services Agency before accepting an offer to work part time. Don't accept an offer of part-time work on your own judgement alone.


Although we don't believe there would be a problem if the part-time work were at another restaurant and consisted of the same activities as permitted by your current status of residence and in which you are currently engaged, you would be required to submit a notification of the affiliated (contracting) organization (shozoku [keiyaku] kikan ni kan suru todokede / 所属(契約)機関に関する届出) regarding your new part-time employer to immigration within 14 days.
You may also need to have obtained permission from your current employer to take up part-time work at another restaurant.


If the content of your prospective part-time job differs from that of your current job, you will need to confirm with immigration that you would be permitted to undertake the work in question part time, and obtain permission to engage in an activity other than those permitted by the status of residence previously granted (shikaku-gai katsudō kyoka / 資格外活動許可). It will be necessary to ensure that the part-time job does not impede your ability to perform the duties of your main job. And to be eligible for consideration for permission to engage in other activities, the part-time work must not be considered by immigration to be unskilled labor (tanjun rōdō / 単純労働), an adult entertainment business (fūzoku eigyō / 風俗営業), an activity in violation of public order and morals (kōjoryōzoku / 公序良俗), or in any way illegal.


If you are considering changing employment, but are unsure whether it would be possible to undertake your prospective new employment with your current status of residence, by applying to immigration for issuance of a certificate of employment qualification (shūrō shikaku shōmeisho / 就労資格証明書), you can obtain certification of whether you can undertake a particular job. You may also find it easier to find a new employer if you have the certificate. For details, please consult an Immigration Services Agency office.
